Terms of Service

1. Acceptance and eligibility

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 13 years old and legally able to enter this agreement. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you. Do not use the Service if applicable law prohibits you from doing so.

If you use the Service for an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

2. Territorial availability

During its initial release, Mappelier offers the interactive Service only to people using it within the United States. We use technical measures to restrict access from other countries. You may not circumvent or attempt to circumvent those regional controls.

The event catalog may include events located outside the United States for people using the Service within the United States. Catalog coverage does not mean that Mappelier offers the interactive Service in every country represented in the catalog. We may expand, restrict, or otherwise change territorial availability over time.

3. The Service

Mappelier helps people discover, map, save, and submit information about art events. Event listings may be collected from public sources, supplied by users, or organized with automated tools. Features and geographic availability may change over time.

Mappelier does not organize, own, ticket, sponsor, or endorse listed events unless we state otherwise. Event dates, locations, admission terms, availability, accessibility, and other details can change. Confirm important details directly with the organizer before traveling, purchasing tickets, or making other commitments.

4. Accounts and security

You are responsible for accurate account information, safeguarding your credentials, and activity under your account. Notify us promptly at support@mappelier.com if you suspect unauthorized access. We may require verification before restoring access or acting on an account request.

5. Your submissions

You retain ownership of content you submit. You grant Mappelier a worldwide, non-exclusive, royalty-free, sublicensable license to host, copy, format, adapt, display, distribute, and use submitted content as needed to operate, secure, improve, and promote the Service and its public event catalog. This license continues for public event information incorporated into the catalog after you close your account.

You represent that you have the rights and permissions needed to submit the content and that it is accurate to the best of your knowledge. Do not submit confidential information, unlawful content, malware, or personal information that should not be public. We may edit, refuse, remove, merge, or retain listings to maintain quality, safety, and catalog accuracy.

6. Acceptable use

You may not:

• Use the Service unlawfully or violate another person’s rights.
• Submit false, deceptive, infringing, harmful, or unauthorized content.
• Probe, disrupt, overload, or bypass the Service’s security or access controls.
• Use automated means to scrape or access the Service contrary to posted instructions.
• Reverse engineer the Service except where applicable law expressly permits it.
• Use the Service to develop or train a competing dataset or service without permission.
• Misrepresent affiliation with Mappelier, an organizer, or another person.

7. Third-party services and links

The Service links to organizers, ticketing services, maps, calendars, image hosts, and other third parties. Their services and content are governed by their own terms and privacy practices. Mappelier is not responsible for third-party content, transactions, availability, safety, or conduct. Your dealings with third parties are between you and them.

8. Intellectual property

The Service, including its software, design, branding, and original content, is owned by Mappelier or its licensors and is protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you. Third-party event content and marks remain the property of their respective owners.

If you believe content on the Service infringes your rights, email support@mappelier.com with enough information for us to identify the work, the disputed material, your contact information, and the basis for your request.

9. Account communications

We may send service-related communications needed to administer your account, security, or these Terms. Delivery is not guaranteed and may be delayed or unavailable.

10. Suspension, termination, and account deletion

You may stop using the Service at any time and may delete your account in Settings. We may suspend or terminate access, remove content, or limit features if we reasonably believe you violated these Terms, created risk or harm, or if needed to comply with law. Provisions that by their nature should survive termination will survive, including ownership, licenses, disclaimers, liability limits, and dispute terms.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Mappelier disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted or error-free operation. We do not warrant that listings, maps, automated output, or third-party content are complete, current, or correct.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded where you live.

12. Limitation of liability

To the maximum extent permitted by law, Mappelier and its officers, members, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or travel costs, arising from or related to the Service.

To the maximum extent permitted by law, their aggregate liability for all claims relating to the Service will not exceed the greater of US $100 or the amount you paid Mappelier for the Service during the 12 months before the event giving rise to the claim. These limitations do not apply where prohibited by law.

13. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold Mappelier harmless from third-party claims, damages, and reasonable costs arising from your submissions, your unlawful misuse of the Service, or your material violation of these Terms or another person’s rights.

14. Governing law and disputes

Maryland law governs these Terms, without regard to conflict-of-law rules. Subject to any mandatory consumer protections or venue rights that apply where you live, state and federal courts located in Baltimore City, Maryland will have exclusive jurisdiction over disputes arising from these Terms or the Service. Before filing a claim, please contact us and allow 30 days to try to resolve it informally.

15. Changes to the Service or these Terms

We may modify or discontinue features and may update these Terms. We will post revised Terms with a new effective date and provide additional notice when required. Changes apply prospectively. Continued use after revised Terms take effect means you accept them; if you do not agree, stop using the Service and delete your account.

16. General

These Terms and the Privacy Policy are the entire agreement about the Service. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining terms will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, financing, reorganization, or transfer of the Service.
